Wallet Terms Of Use
These Terms constitute a legally binding contract made between you and ONE Championship (Singapore) Pte. Ltd. (“ONE”, “us” or “we”) with respect to the digital wallet on Sui blockchain (“Sui”) that is linked to your ONE Passport. Sui is a layer-1 blockchain and smart contract platform that is developed by independent third-parties.
Generating a self-custodial digital wallet. Upon your acceptance of the terms and sign up to the ONE Passport, you agree to generate a self-custodial digital wallet on Sui which is enabled by zero-knowledge proof technology provided by a third-party service provider. The digital wallet is linked to the email credentials that you use for log-in to ONE Passport. ONE does not have knowledge of or access to the private keys, seed phrase, or password associated with your digital wallet. We are not custodians of your digital wallet or any assets therein. None of your personal information is shared with any third-party for the creation of your digital wallet. We do not develop, operate, control, own, maintain, or manage Sui or your digital wallet, and will not be responsible for any risks or activities associated with your digital wallet or Sui. You acknowledge that you may be unable to access your digital wallet, or the contents or assets in your digital wallet, if you lose the private keys, password or seed phrase associated with your digital wallet. Your access and use of your digital wallet and Sui are at your own risk and responsibility.
ONE Services. You acknowledge and agree that certain activities will be entered into using your digital wallet when you log-in to ONE Passport and interact with features, products and services of ONE that are indicated to be powered by the Sui blockchain. Unless expressly stated, none of the activities on ONE that interact with your digital wallet will require you to purchase, sell, deposit, exchange, or transfer any digital payment tokens to or from your digital wallet. We reserve the right to deactivate, suspend, or cease any features, products and services of ONE available to you in our sole discretion for any reason whatsoever, including to comply with applicable laws and regulations.
For the avoidance of doubt, ONE does not offer or provide to you any payment service as defined under the Payment Services Act 2019 of Singapore, including but not limited to dealing in digital payment tokens, facilitating the exchange of digital payment tokens, transfer of digital payment tokens from one digital wallet to another, safeguarding digital payment tokens, inducing any person to enter into any agreement to buy or sell digital payment tokens, or carrying out instructions for any user relating to digital payment token.
Disclaimer. We expressly disclaim all representations and warranties with respect to Sui or your digital wallet (including the generation thereof), including but not limited to the security, availability, accuracy, reliability, performance, legality, fitness for purposes, and non-infringement. We make no representation, warranty, guarantee, undertaking, or assurance, whether express or implied, with respect to your digital wallet or Sui, including but not limited that (1) use of your digital wallet and Sui will meet your requirements; (2) your digital wallet or Sui will be available, secure, error-free, or free of vulnerabilities or bugs or viruses. You further acknowledge that Sui may cease to operate or experience interruptions or failures, whether due to defects, regulatory enforcement actions or otherwise, thus affecting the availability of your digital wallet and access to certain features, products or services of ONE that are indicated to be powered by the Sui blockchain. Nothing in these Terms shall be construed as advice, recommendation, endorsement, advertisement or solicitation in respect of Sui, any digital wallet, digital payment token or any cryptocurrency.
Limitation of Liability. You understand and agree that ONE shall not be liable for any claims, losses, damages, expenses or other liabilities, whether in contract, tort, or otherwise, arising out of or in connection with your digital wallet or Sui, including but not limited to malfunction or security breach, errors, bugs, flaw, defects, interruptions or cessations and unauthorized access.
No duties. You acknowledge and agree that nothing in these Terms are intended to or create or impose any fiduciary duties or any other duties or obligations on us. You expressly waive and release ONE from any and all liability, claims, damages, causes of actions, rights, obligations or every kind whatsoever arising from or in connection with your digital wallet or Sui.
Modifications. We reserve the right, at our sole discretion, to change or modify any portion of these Terms at any time. Any updates to the Terms will be posted on our website and will indicate at the top of this page the date that these Terms were last revised. If you do not agree to the revised Terms, you should not access, use or interact with your digital wallet, or any of the features, products or services of ONE that are powered by Sui blockchain. ONE will not be liable to you for any losses suffered in connection with any revisions to the Terms.
These Terms are governed by the laws of Singapore.
